How to fire someone with an eye on potential lawsuits starts when you first make the hire and your employer/employee relations, while the employee is in your hire.
Do not discriminate. Be sure you are aware of legal hiring tenets. Also keep an employee manual that tells each employee his or her rights as well as obligations.
